Cabinet agreed that legal costs associated with the transaction be funded through the legal budget

 

Cabinet authorised the Director for Places, in consultation with the Cabinet Member with portfolio for Planning, Environment, Property and Finance to agree the final terms, including the precise area of land, generally in line with the Heads of Terms.

1.1 That the Strategic Director of Places in consultation with the Deputy Director Corporate Governance be able to make decisions in specific matters and cases relating to the application, administration, amendment, financial review and enforcement of the Community Infrastructure Levy Charging Schedule and Scheme as set out in Appendix 1 of this report, pursuant to the Community Infrastructure Levy Regulations 2010 (as amended) and adopted by the Council on 1st March 2016;

 

1.2  That the Strategic Director of Place in consultation with the Section 151 Officer and Deputy Director Corporate Governance, and the Portfolio Holders for Planning and Resources be able to make decisions relating to temporary amendments to the Council’s CIL instalment policy in response to the Covid-19 situation;

 

1.3  That the Strategic Director of Places in consultation with the Portfolio Holder for Planning be able to make decisions in specific matters and cases relating to the application, administration, amendment, and review of outstanding Section 106 agreements as set out in paragraph 3.11 of this report, where this affects the provision of community facilities consultation will also be with the relevant ward Member;

 

1.4  That the Strategic Director of Place in consultation with the Section 151 Officer and Deputy Director Corporate Governance, and the Portfolio Holders for Planning and Resources be able to make decisions relating to the expenditure of Section 106 monies up to a value of £500,000 to deliver infrastructure and community facilities in accordance with the provisions of each individual obligation;

 

1.5  To the publication of a public statement that Exceptional Circumstances Relief would become available in the area of the Council;

 

1.6  To the Exceptional Circumstances Relief Policy as set out at Appendix 2 and to take all appropriate steps to ensure that the Policy becomes applicable to the adopted Community Infrastructure Levy (“CIL”) in the area of the Council.

Cabinet approved that the additional Pothole and Challenge Funding received of £1,295,000 be used for carriageway works and added to the Highways Capital Maintenance Programme originally approved in April 2020.

 

Cabinet noted that the total value of the revised Highways Capital Maintenance Programme was now £3,252,000.

 

Cabinet delegated to Director of Places in consultation with Portfolio Holder for Culture and Leisure, Highways & Transportation & Road Safety and Portfolio Holder for Resources the authority to re-prioritise the planned programme of highways schemes if necessary up to a threshold of 20% of total programme value.

22/07/2020 - Decision to fund a Nurture provision at Edith Weston Primary Academy to enable the school to operate a facility and develop primary outreach support ref: 628    Recommendations Approved



The DfE have provided Special Provision Capital Fund of £848,837 over three years (201821) to enable RCC to meet Programme Objectives:

• Use the DfE Capital funding to provide in-county educational places for students with Special Educational Needs or Disabilities (SEND) and who have an Education, Health and Care plan (EHCP). • Increase local provision and be less reliant on out of county or independent provision, so that children with SEND have excellent access to local education. Children who are able to attend, are better able to build positive peer and community links and are more prepared for adulthood and independence. • Give effective transitions for children from Primary to Secondary school and to post 16 provision and onto adulthood. • Manage the flow of young people into secondary education and ensure that the have opportunities to experience a supportive mainstream curriculum. • Have a positive impact on the financial cost and physical impact of transporting children with SEND which comes from the RCC General Fund.
Grow quality of practice and support to families, and respond to what children and families tell us is important about local schools and services. • Resources to be deployed to meet wider SEND system changing strategic objectives. Assist in encouraging aspirational inclusion leadership in schools, ensuring that staff have skills and confidence to support children in mainstream education where this is possible. • Lead to a longer term positive financial impact on the High Needs Block- Designated Schools Grant.
