To make TRO according to proposal and implement.

The approach to be adopted by traffic authorities in considering whether to make a TRO should be as follows:
(1) The decision-maker should have in mind the duty (at S.122 of the 1984 Act) to secure expeditious, convenient and safe movements of vehicular and other traffic including pedestrians in so far as is practicable (NB this case also confirmed that “traffic” extends to include pedestrians)
(2) The decision-maker should then have regard to factors which may point in favour of imposing a restriction on that movement; such factors will include the movement on the amenities of the locality and other relevant factors including those set out at S.1 of the 1984 Act
(3) The decision-maker should then balance the various considerations and come to the appropriate decision

Decision:

Following formal consultation, responses received by RCC, several responses questioned the need for restrictions as proposed and suggested elements outside the scope of the proposal.

The purpose of the TRO is to benefit all highway users including residents - helping with expeditious, convenient and safe movement, especially in the context of a school area on an A road.
Factors the Council have considered which mean that a restriction needs to be imposed are:
• a need to help with expeditious, convenient and safe movement, especially in the context of a school area on an A road.
• a need to prioritise access for residents
• displacement to intended unrestricted areas
It is recommended to make TRO as proposal there is no material reason not to.
Other representations were made based on either personal preference or inconvenience caused by the proposal but were not considered to override the objective of providing a benefit to all highway users.

12/11/2020 - Approval to the terms of waste contract extensions terminating 31st March 2024 with Biffa, FCC and Mid UK ref: 681    Recommendations Approved

To put in place contract extensions for three of the principle waste contracts

With the advent of the Covid restrictions there was insufficient time available to be able to successfully complete retendering prior to existing contract expiry. The proposal achieves a common expiry date then allowing for a holistic retendered contract to run from 1st April 2024. This is beneficial at a number of levels. This also will allow essential work relating to the review of the Council’s waste strategy and associated options appraisal to take place.

The above existing contracts have varying expiry dates, FCC expiring 31st March 2021, the others on 31st March 2022. The proposal achieves the extension of all contracts to a common termination date of 31st March 2024.       I.         Cabinet noted the ongoing work to review the management and administration of the Community Infrastructure Levy.

 

    II.         Cabinet approved that following detailed investigation and receipt of independent legal advice that no further action is taken regarding any potential Community Infrastructure Levy liability with respect to the 8 applications identified in Appendix 1 to this report.

 

   III.         Cabinet agreed to ‘write off’ £150,425.26 potential income associated with the 8 applications identified in Appendix 1.

 

  IV.         Cabinet delegated to Strategic Director – Places in consultation with the Section 151 Officer and Portfolio Holder for Resources the authority to approve a further ‘write off’, if necessary, of up to £31,000 to conclude outstanding historic CIL liability cases.

 

Additional recommendation:

 

      V.            Cabinet agreed to recommend to Council that payments be made to Parish Councils for the CIL money that they would have received but for the issues described in the Report
